Getting a divorce is not a move that people make casually. Even the simplest divorce can be fraught with emotional turmoil and financial expenses. And if a couple has been together for a long time or if there are children involved, the matter is that much more serious and consequential.
As it stands in Texas, married couples can file for divorce on a variety of grounds, including if they have grown incompatible. But if a new bill called HB 93 is passed into law, couples will not be able to cite insupportability as a basis for divorce.
Perhaps supporters of such a law feel that it is currently too easy for couples to divorce and that threatens the institution of marriage. And there are plenty of other reasons that permit a couple to get a divorce, which include conviction of a felony, abandonment, confinement in a mental hospital, and cruelty.
But an argument against the law is that you cannot legislate love. And if you disallow insupportability as the cause then couples may be forced to perjure themselves by claiming another cause when filing for divorce.
So, we shall see if HB 93 becomes a bona fide law in Texas. But for the time being, If you are truly unhappy in your marriage, you may wish to discuss the possibility of getting a divorce with a knowledgeable family law attorney.
